WILL YOU DEFEND ME?

  • Will you defend me, regardless of the type of criminal charge I am facing? YES. Mr. Vayeghan strongly believes in the constitutional principle that all individuals, regardless of the type of criminal allegations that they are facing, are entitled to have their rights protected by a criminal defence lawyer. Indeed, this is at the hallmark of a healthy and proper functioning democracy. This is what distinguishes Canada from many tyrannical nations around the world where a mere criminal allegation by state authorities, even in the face of weak police evidence, can lead to public shaming, conviction, imprisonment, and worse. For these reasons, Mr. Vayeghan is prepared to defend you regardless of the type of criminal charge you are facing.   • The police are investigating me for a crime. Can you help me? YES. If you have been asked to an interview with a police officer, there is a chance that the police are attempting to build a criminal case against you. With the sole exception of providing your name and date of birth to a police officer upon arrest, you are not require by law to say anything to the police. You have the absolute right to remain silent. Mr. Vayeghan strongly recommends that you contact our Firm immediately if you have been asked to a police interview.


I HAVE BEEN ARRESTED

  • I have been arrested by the police. Should I speak to the police? NO. You have the constitutional right to remain silent. With the sole exception of providing your name and date of birth to a police officer upon arrest, you are not required to say anything at all to the police. The decision to talk to the police is entirely your choice. However, you should know that anything you say to the police can and will be used against you in a court of law. Furthermore, upon arrest, you have the constitutional right to be informed of the reason for your arrest and you are entitled to contact a lawyer to seek advice without delay. Mr. Vayeghan advises all of his arrested clients to remain silent upon arrest. If you have been arrested or believe you are about to be arrested, please immediately contact Vayeghan Litigation to seek legal advice.

  • I am in custody right now. Why should I hire you to handle my bail? Bail is a critical moment in the criminal justice process for anyone who is accused of a crime. If you are arrested and have been taken into custody, you must be brought before a justice so that it can be decided whether you should be released into the community on bail. In some cases, the Crown Prosecutor will oppose your release on bail. This means that the Crown wishes to keep you in jail until your trial, which often is many months away. Denial of bail can have a devastating psychological and practical impact on the life of a client. Pre-trial custody can result in loss of employment or other negative side effects on one’s daily life. That is why it is extremely important for you to hire a lawyer with experience in handling complex bail hearings. Mr. Vayeghan is a former Crown Prosecutor who handled numerous complex bail hearings during his former career as a Crown Counsel for the Province of British Columbia.   • Is your law firm available 24/7, even if I am arrested at night? YES. Vayeghan Litigation’s phone line operates on a 24/7 basis. If you are arrested, you can contact our firm at all hours. As soon as Mr. Vayeghan is notified of your arrest, he will start working to secure your release from custody. Mr. Vayeghan understands that being in custody is incredibly difficult and stressful. That is why he utilizes every possible legal avenue to afford you with the best chance of getting released into the community on bail.


MY COURT APPEARANCES

  • If I retain you, do I need to attend Court? NO. Upon retaining Mr. Mo Vayeghan as your criminal defence lawyer, Mr. Vayeghan will make ALL court appearances on your behalf to ensure you do not miss work. You will not need to attend court unless Mr. Vayeghan expressly informs you that your personal attendance is required.


I am a Victim of Crime

  • Will you represent me if I have been a victim of a crime? NO. Vayeghan Litigation only acts for individuals who are charged with criminal offences or are under police investigations. The Firm does not act for individuals who believe that they have been a victim of crime. If you believe that a criminal offence was committed against you, please contact the police.
